SJ AB General Terms and Conditions for Customer Numbers

1. Applicability

1.1. These General Terms and Conditions shall apply when a company (the "Company") registers via SJ AB's website and thereafter receives an SJ customer number (the "Customer Number"). The Customer Number entitles the Company to purchase business travel operated by SJ as well as other travel services from SJ's existing range from time to time (hereinafter referred to as "Travel Services") on favourable terms and conditions pursuant to SJ's price offer applicable from time to time.

2. Customer Number

2.1. An issued Customer Number can be used in conjunction with ordering and purchase of Travel Services for the Company's employees. The Customer Number may also be used as a basis for travel statistics.

3. Purchase and routines regarding Travel Services

3.1. In order to receive SJ's offer applicable from time to time, the Customer Number must be stated at the time of ordering. This shall apply to purchase of Travel Services via SJ's purchasing channels, as well as via travel agencies and through agents. However, it is not possible to make a purchase using a Customer Number in SJ's ticket machines, or at Pressbyrån or 7-Eleven.

3.2 It is also possible for the Company to affiliate employees to its customer number and thereby enable the employees to order Travel Services autonomously using the Company's customer number at www.sj.se and in the SJ App. The Company must provide an email address for all employees affiliated pursuant to the above. A unique user identity and password for each affiliated travel booker/passenger is obtained through SJ's website, www.sj.se.

3.3. Purchase of Travel Services without provision of a Customer Number shall not result in a price deduction or inclusion in statistical documentation. There is no retroactive registration of a ticket purchase.

3.4. A booking fee is applied to purchases through SJ's sales channels.

4. Payment methods and terms and conditions

4.1. Payment for a Travel Service takes place either in cash, using a bank card or a credit card, against invoice issued by SJ, or via a so-called travel account at a credit card company linked to the Customer Number. 5. SJ's other undertakings

5.1. SJ undertakes to save data regarding the Company and the Company's purchase of Travel Services in order to be able to provide statistics to the Company and to offer easier administration in conjunction with new purchases of Travel Services.

5.2. SJ also undertakes to provide, based to the greatest extent possible on the Company's purchases of Travel Services for the Company's employees, personalized offers, personalized marketing, and updated information. Employees of the Company who are affiliated to the Customer Number shall gain access to offers and other benefits, if any, which follow from SJ Biz, via email, when logged in to SJ's app, on www.sj.se, or via text message.

5.3. SJ reserves the right to provide different benefits and offers stated in section 5.2 to different companies/employees with Customer Numbers. For example, different benefits may be given only to affiliated companies/employees with a certain purchasing pattern, a certain purchasing volume, or to companies with addresses within a specific territory.

6. Responsibility and misuse 

6.1 The Company is responsible for payment for all travel documents which are ordered and issued using the Company's Customer Number. In the event of suspected misuse of a Customer Number, the Company should notify SJ immediately for blocking so that a new Customer Number can be obtained.

7. Processing of personal data

7.1. SJ is the controller of personal data for the data which is submitted to SJ. SJ processes personal data in accordance with data protection legislation applicable from time to time. Read more about SJ´s handling of data protection: see www.sj.se/dataprotection.

7.2. The Company shall be responsible for its own processing of personal data, which includes, inter alia, transmission of the personal data to SJ.

7.3. SJ grants travel agents and other retailers retained by the Customer the right to review personal data belonging to the Customer's employees for the purpose of facilitating booking of journeys using the Customer Number.

7.4. The Company is responsible for minimising the quantity of personal data transmitted to SJ within the scope of an authorisation pursuant to section 3.2. The Company further undertakes to ensure that the data which is provided is correct, kept updated during the term of the agreement, and only includes employees who wish to be affiliated to the customer number. The Company shall delete data belonging to employees whose employment has terminated.

 

8. SJ's right to revoke a customer number and terminate customer numbers

8.1. SJ shall be entitled to revoke the Company's Customer Number with immediate effect and with no prior notice where the Company: (i) breaches its undertakings under these General Terms and Conditions; or (ii) does not use the Customer Number for a 12-month period.

8.2 SJ shall be entitled, with three months' notice, to cease providing SJ customer numbers and, in conjunction therewith, to terminate the Customer Number.

9. Assignment

9.1. The Company may not assign its Customer Number or any of its rights or obligations under these General Terms and Conditions to any third party.

10. Force majeure 

10.1. SJ shall not be liable for undertakings set forth in these General Terms and Conditions to the extent that the performance thereof is prevented as a result of decisions by governmental authorities, acts of war, natural disasters, strikes, blockades, boycotts, sabotage, lockouts, or other similar circumstance.

11. Other terms and conditions

11.1 SJ's General Terms and Conditions of Purchase applicable from time to time shall apply to purchase of a Travel Service under SJ's auspices, and SJ's General Terms and Conditions of Travel applicable from time to time shall apply to journeys operated by SJ.

11.2. SJ complies with SJ's codes of conduct applicable from time to time.

11.3. All the above documents are available at sj.se.

12. Dispute and choice of law

12.1. Disputes arising in respect of these General Terms and Conditions shall be conclusively resolved by a Swedish court applying Swedish law.

13. Entry into force

13.1. These General Terms and Conditions for SJ Customer Number shall enter into force on  25 May 2018.
